Service Description

Washington Pest Control provides residential and commercial pest management services throughout the state of Washington. Our services include inspection, identification, treatment, and ongoing monitoring of pest activity for insects, rodents, and other wildlife commonly found in the Pacific Northwest region. Specific treatment methods, frequencies, and coverage areas are determined based on property conditions, pest pressures, and the service agreement entered into between Washington Pest Control and the client. We utilize integrated pest management approaches that may include chemical applications, mechanical controls, exclusion techniques, and environmental modifications as appropriate for each situation. All services are performed by licensed technicians in accordance with Washington State Department of Agriculture regulations and applicable federal guidelines. Service appointments are scheduled during normal business hours, with emergency services available under separate terms where specified in your service agreement.

No Guarantee or Warranty

Washington Pest Control does not guarantee complete elimination of all pests from your property. Pest control results depend on numerous factors beyond our control, including but not limited to: weather conditions, structural integrity of buildings, sanitation practices, neighboring properties, and the biology and behavior of target pest species. We do not warrant that our services will prevent future infestations or that treated areas will remain pest-free indefinitely. Any warranties or guarantees specifically offered will be set forth in a separate written service agreement and are limited to the terms explicitly stated therein. We make no representations regarding the effectiveness of our services for health-related concerns, including the prevention of disease transmission by pests. Clients should maintain realistic expectations and understand that pest management is an ongoing process rather than a one-time permanent solution.

User Responsibilities

Clients must provide accurate and complete information regarding pest issues, property conditions, and any health or safety concerns that may affect service provision. You are responsible for preparing your property prior to scheduled treatments, which may include removing pets, clearing access to treatment areas, and securing food preparation surfaces as instructed by our technicians. Clients must disclose the presence of children, elderly individuals, pregnant persons, or individuals with chemical sensitivities or respiratory conditions prior to treatment. You agree to follow all post-treatment instructions provided by Washington Pest Control, including re-entry timelines and ventilation requirements. Failure to comply with these responsibilities may result in service delays, additional charges, or diminished effectiveness of treatments. Clients must promptly report any adverse reactions, continued pest activity, or property damage concerns following service. You are responsible for maintaining reasonable sanitation and structural conditions that support pest management efforts between scheduled services.

Limitation of Liability

To the maximum extent permitted by applicable law, Washington Pest Control shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, lost profits, or emotional distress. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim during the twelve months preceding the incident. This limitation applies regardless of whether damages are sought in contract, tort, negligence, strict liability, or any other legal theory. We are not liable for damage to personal property, landscaping, or structural elements unless caused by our gross negligence or willful misconduct and proven by clear and convincing evidence. We are not responsible for allergic reactions, chemical sensitivities, or health conditions exacerbated by treatment materials, provided such materials were applied in accordance with manufacturer specifications and regulatory requirements. Clients assume responsibility for selecting appropriate service levels and communicating relevant health and safety information.

Intellectual Property

All content, materials, and intellectual property associated with Washington Pest Control, including but not limited to our business name, logos, service marks, trade dress, website content, marketing materials, treatment protocols, and proprietary methodologies, are owned exclusively by Washington Pest Control or our licensors. Clients and users are granted no license or right to use any of our intellectual property except as necessary to receive and identify our services. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our materials without prior written consent. Any feedback or suggestions provided to Washington Pest Control may be used without restriction or compensation. We reserve all rights not expressly granted herein.

Governing Law

These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any legal action or proceeding relating to these terms or our services shall be brought exclusively in the state or federal courts located in King County, Washington. Clients consent to the personal jurisdiction and venue of such courts. The provisions of these terms are severable, and if any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The failure of Washington Pest Control to enforce any right or provision shall not constitute a waiver of such right or provision. These terms constitute the entire agreement between you and Washington Pest Control regarding the subject matter herein.

Changes to Terms

Washington Pest Control reserves the right to modify or update these Terms of Service at any time without prior individual notice. Material changes will be posted on our website with an updated effective date. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. If you do not agree to the modified terms, you must discontinue use of our services and notify us in writing to terminate any ongoing service agreement in accordance with the cancellation provisions specified therein. Changes will not apply retroactively to disputes or incidents that arose prior to the effective date of modification.
